OVERVIEW
This website is operated by TUFA Climbing LLC ("TUFA," "we," "us," or "our"). TUFA designs and manufactures handmade technical climbing gear and accessories at our studio in Kalispell, Montana. By accessing this website at tufaclimbing.com (the "Site") or purchasing any product from us, you ("you" or "Customer") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use this Site or purchase our products.
Our store is hosted on Shopify Inc., which provides the e-commerce platform through which we sell our products.
SECTION 1 — ELIGIBILITY
By agreeing to these Terms, you represent that you are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater. If you are purchasing on behalf of a minor, you accept full responsibility for the minor's use of any products purchased through this Site.
SECTION 2 — PRODUCTS AND HANDMADE NATURE
2.1 — Handmade Products
All TUFA products are designed and constructed by hand at our studio in Kalispell, Montana. Due to the handmade nature of our products, slight variations in stitching, color, texture, and dimensions may occur between individual units. These variations are inherent to handmade construction and are not considered defects. Each product is individually inspected before shipment.
2.2 — Product Descriptions and Imagery
We make every effort to display product colors, materials, and specifications as accurately as possible. However, actual product appearance may vary due to differences in monitor settings, photography lighting, and the handmade construction process. Product descriptions, including weights and dimensions, are approximate and may vary slightly between individual units.
2.3 — Limited Quantities and Availability
Many TUFA products are produced in limited quantities. We reserve the right to limit the quantity of any product sold per customer, per household, or per order. We reserve the right to discontinue any product at any time without notice. Product availability is not guaranteed and items may sell out without prior notification.
2.4 — Pre-Orders and Made-to-Order Products
Certain products may be offered on a pre-order or made-to-order basis. Estimated production and shipping timelines are provided in good faith but are not guaranteed. Handmade production timelines may vary due to material availability, production complexity, and order volume. By placing a pre-order, you acknowledge and accept that delivery dates are estimates and delays may occur.
SECTION 3 — ASSUMPTION OF RISK AND PRODUCT USE
3.1 — Inherent Risks of Climbing and Outdoor Activities
TUFA products are designed for use in rock climbing, alpine climbing, mountaineering, and other outdoor activities. These activities are inherently dangerous and involve risks of serious injury or death, including but not limited to: falls, rockfall, avalanche, weather exposure, equipment failure, and human error.
By purchasing and using any TUFA product, you acknowledge and accept that:
(a) Climbing and outdoor activities carry inherent and unavoidable risks that no product design or construction can fully eliminate.
(b) You are solely responsible for determining whether any TUFA product is appropriate for your intended use, skill level, and conditions.
(c) You are solely responsible for inspecting all products before each use, maintaining products according to any care instructions provided, and retiring products that show signs of wear, damage, or degradation.
(d) TUFA products are designed as carry systems, storage, and organizational gear. They are not life-safety equipment, personal protective equipment (PPE), or fall-arrest devices unless explicitly stated otherwise.
(e) You voluntarily assume all risks associated with the use of TUFA products in any outdoor or climbing activity.
3.2 — No Warranty of Fitness for Specific Conditions
While TUFA products are designed for alpine and climbing use, we make no warranty or representation that any product is suitable for every specific condition, route, terrain, weather scenario, or activity you may encounter. Users must exercise independent judgment regarding the suitability of any product for their intended application.
3.3 — Modifications
Any modification, alteration, or repair of a TUFA product by anyone other than TUFA voids all warranties and releases TUFA from any and all liability associated with that product. This includes but is not limited to: cutting, sewing, gluing, adding hardware, removing components, or altering the structure or materials of any product.
SECTION 4 — INTELLECTUAL PROPERTY
4.1 — Ownership
All content on this Site — including but not limited to product designs, construction methods, patterns, photography, text, graphics, logos, trademarks, trade dress, and brand identity — is the exclusive property of TUFA Climbing LLC and is protected by United States and international intellectual property laws.
4.2 — Restrictions
You may not reproduce, duplicate, copy, reverse-engineer, disassemble, photograph for the purpose of replication, sell, resell, or exploit any TUFA product design, construction technique, pattern, or proprietary method without the express written permission of TUFA Climbing LLC.
4.3 — Trademarks
"TUFA," "TUFA Climbing," the TUFA logo, "Mochilla," and all other TUFA product names and brand identifiers are trademarks of TUFA Climbing LLC. Unauthorized use of any TUFA trademark is strictly prohibited.
4.4 — Photography and Content
All product photography, lifestyle imagery, video content, and written copy on this Site is the property of TUFA Climbing LLC. You may not use, reproduce, or distribute any Site content for commercial purposes without our express written consent. Personal, non-commercial sharing of product images with proper attribution is permitted.
SECTION 5 — PRICING, ORDERS, AND PAYMENT
5.1 — Pricing
All prices are listed in United States Dollars (USD) unless otherwise indicated. Prices are subject to change without notice. Prices do not include applicable taxes or shipping costs, which are calculated at checkout.
5.2 — Order Acceptance
We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, errors in product or pricing information, suspected fraudulent or unauthorized activity, or orders that appear to be placed by resellers or dealers. If we cancel an order after payment has been processed, we will issue a full refund.
5.3 — Payment
Payment is due at the time of purchase. We accept the payment methods listed at checkout. You agree to provide current, complete, and accurate billing and payment information.
SECTION 6 — SHIPPING AND DELIVERY
6.1 — Domestic Shipping
Free shipping is offered on all orders within the United States over $99. Shipping timelines are estimates and are not guaranteed. Handmade production may affect processing time before shipment.
6.2 — International Shipping
International orders may be subject to customs duties, import taxes, and additional fees imposed by the destination country. These charges are the sole responsibility of the Customer. TUFA is not responsible for delays caused by customs processing.
6.3 — Risk of Loss
Title and risk of loss for all products pass to you upon delivery to the carrier. TUFA is not responsible for lost, stolen, or damaged shipments once the product has been transferred to the shipping carrier. We recommend purchasing shipping insurance for high-value orders.
SECTION 7 — RETURNS AND WARRANTY
7.1 — Return Policy
Please refer to our Return & Refund Policy page for current return terms and conditions.
7.2 — Limited Warranty
TUFA products are warranted against defects in materials and workmanship for a period determined by our current warranty policy. This warranty does not cover normal wear and tear, damage caused by misuse, abuse, neglect, improper storage, unauthorized modification, or use beyond the product's intended purpose.
7.3 — Warranty Remedy
If a product is found to have a defect covered under warranty, TUFA will, at its sole discretion, repair or replace the product. Warranty claims must be submitted to josh@tufaclimbing.com with a description of the defect and photographs. TUFA's decision regarding warranty claims is final.
7.4 — Warranty Limitations
THE WARRANTY SET FORTH IN THIS SECTION IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY TUFA. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUFA DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SECTION 8 — LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TUFA CLIMBING LLC, ITS OWNER, AGENTS, CONTRACTORS, SUPPLIERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:
(a) Your use or inability to use any TUFA product;
(b) Any injury, death, or property damage resulting from the use of any TUFA product in climbing, outdoor, or any other activity;
(c) Any defect, failure, or malfunction of any product, whether or not TUFA was advised of the possibility of such damages;
(d) Your use of or access to this Site;
(e) Any errors, inaccuracies, or omissions in Site content;
(f) Any unauthorized access to or use of our servers or any personal information stored therein.
IN NO EVENT SHALL TUFA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO ANY PRODUCT OR THIS SITE EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
SECTION 9 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless TUFA Climbing LLC, its owner, agents, contractors, suppliers, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of any TUFA product; (b) your breach of these Terms; (c) your violation of any law or the rights of any third party; or (d) any claim that your use of a TUFA product caused injury or damage to any person or property.
SECTION 10 — PRIVACY AND PERSONAL INFORMATION
Your submission of personal information through this Site is governed by our Privacy Policy. By using this Site, you consent to the collection and use of your information as described in our Privacy Policy.
SECTION 11 — USER CONTENT AND COMMUNICATIONS
Any content you submit to us — including feedback, suggestions, ideas, photographs, reviews, or other materials — becomes the property of TUFA Climbing LLC. By submitting content, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, distribute, and display that content in any medium for any purpose, including marketing and promotional use.
You represent that any content you submit does not violate the intellectual property rights, privacy rights, or any other rights of any third party, and does not contain unlawful, defamatory, or otherwise objectionable material.
SECTION 12 — THIRD-PARTY LINKS AND TOOLS
This Site may contain links to third-party websites or integrate third-party tools and services. TUFA does not control, endorse, or assume responsibility for any third-party content, products, services, or practices. Your use of third-party websites and tools is at your own risk and subject to the terms and policies of those third parties.
SECTION 13 — PROHIBITED USES
You agree not to use this Site or any TUFA product for any unlawful purpose. You further agree not to: (a) violate any applicable laws or regulations; (b) infringe upon the intellectual property rights of TUFA or any third party; (c) transmit any malicious code, virus, or harmful content; (d) attempt to gain unauthorized access to any part of this Site or its systems; (e) collect or harvest personal information from this Site; (f) use the Site in any way that could damage, disable, or impair its functionality; or (g) reproduce, reverse-engineer, or replicate any TUFA product design or construction method.
SECTION 14 — DISPUTE RESOLUTION AND GOVERNING LAW
14.1 — Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Montana, without regard to conflict of law principles.
14.2 — Jurisdiction
Any dispute arising from or related to these Terms, any TUFA product, or your use of this Site shall be resolved exclusively in the state or federal courts located in Flathead County, Montana. By using this Site or purchasing any product, you consent to the personal jurisdiction of such courts.
14.3 — Informal Resolution
Before initiating any formal legal action, you agree to contact us at josh@tufaclimbing.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve any concern within 30 days.
SECTION 15 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.
SECTION 16 — ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and TUFA Climbing LLC regarding your use of this Site and purchase of our products. Any prior agreements, communications, or understandings are superseded by these Terms. Our failure to exercise or enforce any provision of these Terms shall not constitute a waiver of that provision.
SECTION 17 — CHANGES TO TERMS
We reserve the right to update or modify these Terms at any time. Changes take effect immediately upon posting to this Site. Your continued use of the Site following the posting of updated Terms constitutes your acceptance of those changes. We encourage you to review these Terms periodically.
